The state of Wisconsin is attempting to eliminate a tax exemption for religious organizations after it failed at the U.S. Supreme Court earlier this year when trying to block a Catholic charity from claiming that tax break.<\/p>\n

The Supreme Court in June unanimously ruled that the state violated the First Amendment <\/a>when it denied a tax exemption to the Diocese of Superior\u2019s Catholic Charities Bureau. The state had argued that the group\u2019s charitable undertakings were not \u201cprimarily\u201d religious and thus failed to qualify for the tax break.<\/p>\n

The Wisconsin Supreme Court had earlier ruled against the Catholic charity before the U.S. Supreme Court reversed that decision. But in an Oct. 21 press release<\/a>, the religious liberty legal group Becket said that the state government is now asking the state Supreme Court to \u201celiminate the exemption entirely.\u201d<\/p>\n

\u201cRather than following the Supreme Court\u2019s ruling, Wisconsin officials are now trying to avoid it by attacking the religious exemption itself,\u201d the group said.\u00a0<\/p>\n

The tax exemption directs that organizations \u201coperated primarily for religious purposes\u201d can be exempt from paying into the state\u2019s unemployment system. In a brief to the state Supreme Court,<\/a> state officials said the tax exemption itself is \u201cdiscriminatory\u201d and that ending the policy would \u201cavoid collateral damage to Wisconsin workers\u201d while satisfying the U.S. Supreme Court\u2019s order.\u00a0<\/p>\n

State officials did not respond to requests for comment from CNA on Oct. 22. Nick Reaves, a senior attorney with Becket, told CNA that eliminating the tax exemption would \u201cjust replace one unconstitutional rule after another.\u201d\u00a0<\/p>\n

Reaves said the U.S. Supreme Court justices in their ruling \u201cclearly contemplated extending the benefit to Catholic Charities\u201d rather than eliminating the benefit altogether.\u00a0<\/p>\n

\u201cIf you eliminate the exemption, it doesn\u2019t solve the constitutional problem, because the state has something like 40 other exemptions for secular groups,\u201d he said. Union groups and organizations that do work in prisons are among the entities that have access to the exemption, he said.<\/p>\n

\u201cThe First Amendment prohibits favoring secular activity over religious activity\u201d in such cases, he said. \u201cOur view is Wisconsin just can\u2019t eliminate the exemption.\u201d<\/p>\n

Reaves said the Catholic charity has a high likelihood of getting its case before the Supreme Court again. \u201cThe chance of getting a hearing at the Supreme Court is low, initially,\u201d he said. \u201cBut they\u2019re much more likely to take a case again if the lower court gets it wrong again.\u201d<\/p>\n

\u201cObviously the Wisconsin Supreme Court will weigh in on this first,\u201d he said. \u201cWe\u2019re hoping our arguments are persuasive there.\u201d<\/p>\n

In its filing, meanwhile, Becket said Wisconsin\u2019s \u201canimus\u201d toward the Catholic charity group is \u201canything but subtle.\u201d\u00a0<\/p>\n
