Colorado violated the First Amendment by telling therapists that they could not help young people struggling with unwanted same-sex attraction, the U.S. Supreme Court said in a March 31 ruling. <\/p>\n

The high court said in an 8-1 decision<\/a> that Colorado\u2019s law banning \u201cconversion therapy\u201d for minors runs afoul of free speech protections and does not qualify as a \u201cpermissible\u201d exception to the First Amendment. <\/p>\n

\u201cThe First Amendment stands as a bulwark against any effort to prescribe an orthodoxy of views, reflecting a belief that each American enjoys an inalienable right to speak his mind and a faith in the free marketplace of ideas as the best means for finding truth,\u201d the ruling said. <\/p>\n

\u201cLaws like Colorado\u2019s, which suppress speech based on viewpoint, represent an egregious assault on both commitments,\u201d the justices said. <\/p>\n

Justice Ketanji Brown Jackson was the lone dissent from the ruling.<\/p>\n

Colorado\u2019s law defined \u201cconversion therapy\u201d as \u201cany practice or treatment\u201d that attempts to change a person\u2019s \u201csexual orientation or gender identity.\u201d<\/p>\n

In its ban the state included efforts to change a person\u2019s \u201cbehaviors or gender expressions or to eliminate or reduce sexual or romantic attraction or feelings toward individuals of the same sex.\u201d<\/p>\n

Christian counselor Kaley Chiles filed a lawsuit to challenge the ban in 2022<\/a>, arguing that her clients come to her for faith-based counseling, and some are referred by churches or word of mouth. <\/p>\n

The lawsuit asserted that the Colorado rule constituted viewpoint discrimination because it expressly permitted therapy that is supportive of gender transitions but prohibited therapy that is rooted in \u201ca religious viewpoint that aligns with [Chiles\u2019] religious beliefs and those of her clients.\u201d<\/p>\n

In its March 31 ruling, the Supreme Court acknowledged that the decision was a \u201cnarrow one,\u201d insofar as it did not address broader prohibitions on \u201cconversion therapy\u201d practices such as \u201cphysical interventions.\u201d<\/p>\n

Chiles herself argued that she \u201cprovides only talk therapy\u201d to her clients, the court noted. She said the law \u201cstrikes at the heart of the First Amendment\u2019s protections for free speech.\u201d<\/p>\n

The state\u2019s law \u201ccensors speech based on its viewpoint,\u201d the justices said, describing the ban as an \u201cegregious\u201d assault on free speech. <\/p>\n

\u201cColorado may regard its policy as essential to public health and safety,\u201d the ruling said. \u201cCertainly, censorious governments throughout history have believed the same.\u201d<\/p>\n

In her dissent, Jackson argued that the First Amendment has \u201cfar less salience\u201d where medical regulations are concerned.<\/p>\n

She alleged that the majority opinion was \u201cunprincipled and unworkable\u201d and \u201cwill eventually prove untenable.\u201d<\/p>\n

Jim Campbell, lead attorney with the legal group Alliance Defending Freedom, which represented Chiles in the case, said in a press release<\/a> that the ruling was \u201ca significant win for free speech, common sense, and families desperate to help their children.\u201d<\/p>\n
