The Constitutional Court of the Czech Republic on April 1 found that parts of a treaty between the Czech Republic and the Holy See are inconsistent with the Czech constitution and therefore cannot be ratified.<\/p>\n

\u201cWe disagree with the decision of the majority of judges at the Constitutional Court but accept it,\u201d the Czech Bishops’ Conference wrote<\/a> in a press release. The episcopate finds it \u201cpositive that the court did not reject the idea of the existence of a treaty with the Holy See but only limited itself to partial passages.\u201d<\/p>\n

The agreement on certain legal issues was signed in 2024 by Vatican Secretary of State Cardinal Pietro Parolin and then-Prime Minister Petr Fiala. It was later approved by both chambers of the country\u02bcs Parliament and was submitted to the president of the country for ratification. <\/p>\n

However, a group of senators filed a complaint with the Constitutional Court, which on April 1 stated that two parts of the accord are problematic.<\/p>\n

The ruling says that the concordat would \u201cgive Catholic Church legal entities a powerful tool to prevent their documents (archive materials) from being made available.\u201d Church archives are important sources of cultural wealth and history, but the accord would \u201cexempt Catholic churches from the obligation to respect the Archives Act, which would, however, continue to apply to all other churches,\u201d the court explained.<\/p>\n

The second objection deals with the seal of confession, which would be enacted without any exceptions and would be \u201ca clear violation of the neutrality of the state and the principle of equal treatment of different churches.\u201d <\/p>\n

Each side of the treaty understood it differently, the ruling observed, adding that the seal of confession would be more protected than professional secrecy.<\/p>\n

Dissenting opinions<\/h2>\n

Three out of 15 judges of the Constitutional Court presented a different position, arguing the court did not deal with an important part of the legal file presented by senators, such as objections to \u201cthe alleged privilege of the Catholic Church in the provision of pastoral care in various types of institutions and facilities.\u201d<\/p>\n

However, they admitted that \u201cthe Holy See is a subject of international law, which the Czech Republic has recognized,\u201d and so it is \u201cundoubtedly an objective reason for the different treatment of the Catholic Church in various issues.\u201d They further argued that the two problematic passages in the majority decision are not in conflict with the constitution.<\/p>\n

Another two judges presented a different position each. One of them, Judge Tom\u00e1\u0161 Lang\u00e1\u0161ek, argued that \u201cthe dissenting opinions show that it was possible to adopt a rational interpretation of the concordat in good faith that would not in any way conflict with the constitutional order.\u201d<\/p>\n

He said he considers the decision \u201ca paradigmatic change in the role and function of the constitutional judiciary.\u201d The Constitutional Court opposed the intention of the Parliament \u201cto take on an international legal obligation to maintain\u201d the already existing and \u201clegally guaranteed standard of protection of fundamental religious rights and freedoms in [the] future,\u201d Lang\u00e1\u0161ek opined.<\/p>\n

\u201cThe court\u02bcs concern for equal treatment among churches and religious communities is only a proxy problem,\u201d the constitutional judge added.<\/p>\n

\u2018A legal defeat for people who consider religious freedom an important value\u2019<\/h2>\n

\u201cIt is a political victory for some, and a legal defeat for people, believers and nonbelievers, who consider religious freedom an important value,\u201d commented Jakub K\u0159\u00ed\u017e, a lawyer who teaches at the Catholic Theological Faculty of Charles University in Prague.<\/p>\n

At the same time, he said he believes \u201cthe absence of a concordat is not a tragedy\u201d either for religious freedom or \u201cfor Catholics who, after all, always benefit the most when the state does not get along with them.\u201d<\/p>\n

The proposal \u201cwould have had no chance of success if\u201d Czech President Petr Pavel \u201chad not intervened and introduced new arguments,\u201d for example suggesting that \u201cthe agreement contradicts the sovereignty of the state and its secular and republican character,\u201d the scholar underscored.<\/p>\n

The negotiated agreement was \u201cpoor in content, innocent, almost devoid of substance,\u201d and the Czech side did not try to \u201cnegotiate anything beyond what is already in force today,\u201d K\u0159\u00ed\u017e said, adding that it had \u201cmore a symbolic\u201d value.<\/p>\n

\u2018A big disappointment\u2019<\/h2>\n

The decision was a \u201cbig disappointment\u201d and \u201ca very unfortunate event,\u201d lamented Father Ji\u0159\u00ed Rajmund Tretera, a Dominican and professor of canon law at the Faculty of Law of Charles University.<\/p>\n

On the seal of confession, there would be \u201cno change to the current situation,\u201d as all believers \u201cwere guaranteed that the current legal provisions\u201d regarding \u201cconfessional secrecy could not be so easily eliminated\u201d if a religion-averse group \u201ccame to power in our democratic state,\u201d the priest said.<\/p>\n

Tretera also said he believes the Constitutional Court committed \u201can unintentional attack against the ecumenical movement.\u201d It argued that the proposed agreement \u201cwas not in accordance with the principle of equality of all churches,\u201d yet \u201cthis is in conflict with the reality commonly recognized in non-Catholic churches.\u201d<\/p>\n

K\u0159\u00ed\u017e clarified that \u201cnon-Catholic churches did not\u201d oppose the treaty, and \u201cmany even welcomed it, seeing its role as a stabilizer of guarantees of religious freedom.\u201d<\/p>\n

The only way to proceed is \u201cto start negotiations from the beginning,\u201d as this is not \u201ca bill where a sentence can be deleted,\u201d the lawyer warned.<\/p>\n

Yet he said he is skeptical that the Holy See would risk another \u201cembarrassment,\u201d as \u201cthe Czech Republic showed to be a rather unreliable international partner.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"
